These Terms of Use (the “Terms” or “Agreement”) govern your access to and use of the applications, websites, and services provided by Nifty Machines (“Nifty Machines”, “we”, “us”, or “our”).

By downloading, installing, accessing, or using any of our Services, you agree to be bound by these Terms.

1. Services Covered

These Terms apply to all Nifty Machines products and services, including but not limited to:

  • Health Export (iOS application)
  • HeyShifu (Web application)
  • Cropperoo (Web application)
  • Any related websites, updates, features, or support services (collectively, the “Services”)

2. Eligibility

You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use the Services.
By using the Services, you represent that you meet this requirement.

3. License Grant

A. App License (Health Export – iOS)

Subject to your compliance with these Terms, Nifty Machines grants you a limited, non-exclusive, non-transferable, revocable license to download and use Health Export on Apple-branded devices that you own or control, in accordance with Apple’s App Store Terms of Service.

B. Web Services License (HeyShifu & Cropperoo)

We grant you a limited, non-exclusive, non-transferable license to access and use the web Services for their intended purpose.

4. Ownership

The Services, including all software, design, text, graphics, logos, icons, and intellectual property, are owned by or licensed to Nifty Machines.

You do not acquire any ownership rights by using the Services.

5. Restrictions

You agree not to:

  • Copy, modify, distribute, sell, or lease any part of the Services
  • Reverse engineer, decompile, or attempt to extract source code (except where permitted by law)
  • Use the Services for unlawful, abusive, or harmful purposes
  • Interfere with or disrupt the integrity or performance of the Services
  • Circumvent usage limits, security features, or access controls

6. User Content & Data

A. Your Content

You retain ownership of any content, files, or data you upload, input, or generate using the Services (“User Content”).

B. Limited Processing License

You grant Nifty Machines a limited license to process your User Content solely to provide and operate the Services.

We do not claim ownership of your content.

7. Health-Related Disclaimer (Health Export)

Health Export is provided for informational and organizational purposes only.

  • It is not a medical device.
  • It does not provide medical advice, diagnosis, or treatment.
  • Always consult a qualified healthcare professional for medical decisions.

Use of Health Export does not create a doctor-patient relationship.

8. Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect information.

By using the Services, you consent to our data practices as described in the Privacy Policy.

9. Paid Features & Subscriptions (If Applicable)

Some Services may offer paid features or subscriptions.

  • Payments are handled by third-party platforms (e.g., Apple App Store, payment processors)
  • All billing, renewals, and refunds are governed by the platform through which you purchased
  • Prices and features may change at any time

10. Third-Party Services

The Services may interact with or link to third-party services or platforms.

Nifty Machines is not responsible for third-party services, content, or policies.
Your use of third-party services is governed by their own terms.

11. Disclaimer of Warranties

The Services are provided “AS IS” and “AS AVAILABLE”, without warranties of any kind.

To the fullest extent permitted by law, Nifty Machines disclaims all warranties, including:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or reliability of results

We do not guarantee that the Services will be uninterrupted or error-free.

12. Limitation of Liability

To the maximum extent permitted by law:

Nifty Machines shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of data
  • Loss of profits
  • Business interruption

Our total liability for any claim arising from the Services shall not exceed the amount you paid (if any) to Nifty Machines in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Nifty Machines and its affiliates from any claims, damages, losses, or expenses arising from:

  • Your misuse of the Services
  • Your violation of these Terms
  • Your violation of any applicable laws or third-party rights

14. Termination

We may suspend or terminate your access to the Services at any time if you violate these Terms.

You may stop using the Services at any time.
Upon termination, all licenses granted to you will immediately end.

15. Governing Law

These Terms will be governed by applicable laws, without limiting any consumer protection rights you may have under the laws of your country of residence.

16. Apple-Specific Terms (Health Export)

For Health Export users:

  • Apple is not a party to this Agreement
  • Apple has no obligation to provide support for the app
  • Apple is not responsible for any claims related to the app
  • Apple is a third-party beneficiary of this Agreement and may enforce it

17. Changes to These Terms

We may update these Terms from time to time.
Changes take effect when posted on our website or within the Services.

Your continued use of the Services after changes means you accept the updated Terms.
